Ex-Cincinnati Bengals cheerleader Sarah Jones takes to the radio in her defense

Covington, Ky (Cincinnati.com) -- The day former Bengals cheerleader Sarah Jones went on the radio to talk about being charged with having a sexual relationship one of her students at Dixie Heights High School, her attorney filed a motion to have the charges dropped.

Jones' attorney asked a judge on Tuesday to dismiss the indictment of first-degree sexual abuse. Jones claims prosecutors offered no proof to a Kenton County grand jury that a crime occurred. She is also charged with unlawful use of electronic means to induce a minor to engage in sexual or other prohibited activities.

"The Commonwealth does not have ... a single witness that there was any sex," lawyer Eric Deters wrote in the motion. "There is not a single sealed text message that would reflect there was sex in any state, much less Kentucky. There is no confession. There is no admission. There is only speculative conjecture."

The prosecuting attorney, Jefferson County Assistant Commonwealth's Attorney Sara Farmer, couldn't be reached Tuesday afternoon for comment.

Deters also filed a motion seeking to dismiss the indictment against Jones' mother, Cheryl Jones, who is charged with tampering with evidence in the case.

Deters wrote that a detective testified before a grand jury that Cheryl Jones texted someone to "destroy" a mobile phone. Deters said his client didn't use the word "destroy."

Sarah Jones, 27, and her mother talked about the criminal cases against them on Deters' radio show on Tuesday.

Cheryl Jones, who recently retired as principal of Twenhofel Middle School, said on the radio that she told the person in a text to "get rid of the phone," but did not use the word "destroy."

Deters writes in one motion that he thinks Cheryl Jones was charged in the case in order to get her daughter to take a plea deal.

The mother and daughter said they plan to testify at the trial.

Sarah Jones, who taught English at the Edgewood school, said she decided to resign last November after rumors spread around the school.

"Just because it's a rumor, it can be very disruptive to a career," she said.

Sarah Jones said she now works for Deters at his law office.

Deters writes in another motion that Cheryl Jones was forced to retire form her 35-year career as an educator. The mother said she could lose her pension if she is convicted.

Sarah Jones said she is now divorced from her husband Nathan Wilburn, whom she married in July 2011. The couple separated after one month, she said.

Sarah Jones said the accusations against her came from two girls at the school. She claims the two girls lied to police.

The mother and daughter are scheduled to stand trial in October.
