Florida judge hearing Obama ballot challenge

TALLAHASSEE , Fla. (AP) - A judge is considering whether to dismiss a ballot challenge alleging President Barack Obama is not a "natural born citizen."

The plaintiff is represented by conservative legal activist Larry Klayman, who questioned Obama's Hawaiian birth certificate. Klayman also argued Monday that even if Obama was born in the United States he still is not a natural citizen because his father was a foreign national.

Lawyers for the president and Florida Department of State argued the suit challenging Obama's placement on the 2012 Florida ballot as the Democratic presidential nominee doesn't give a cause of action because he hasn't been nominated yet.

Circuit Judge Terry Lewis did not immediately rule.

Klayman also said U.S. Sen. Marco Rubio isn't a natural born citizen. The Florida Republican is a potential vice presidential candidate.
