Tampa, Florida — Lawyers trying to dismiss marijuana charges against Devil Rays outfielder Elijah Dukes argued over a noise ordinance in court today.
Dukes' lawyers tried to argue the ordinance is unconstitutional.
Tampa police pulled him over for playing his music too loud last month. That's when police found marijuana in the car.
The Tampa ordinance says if music is audible 25 feet away the vehicle is in violation. Dukes lawyers say the reason he was pulled over is unconstitutional because it does not use a decibel level to monitor noise.
The judge did not agree with this argument. Now Dukes' lawyers have until Wednesday to submit additional arguments
