Trayvon Martin case: Stand your ground hearing scheduled for George Zimmerman

Sanford, Florida -- A "stand your ground" hearing will be held in the case against George Zimmerman, his attorney, Mark O'Mara has just announced.

Depending on the outcome of this hearing, a judge could decide to throw out the entire case against Zimmerman.

Zimmerman's attorney, Mark O'Mara, just posted an announcement on his law firm's website that his defense team will ask for the special "stand your ground" hearing.

O'Mara's statement says he wanted to wait for the state to release a large part of its evidence against Zimmerman before deciding on whether to request the hearing.

Zimmerman has been charged with second degree murder in the death of Trayvon Martin.

His attorneys were already planning to argue Zimmerman shot Martin in self-defense.

This hearing will take that defense one step further.

It's essentially a mini-trial, held before the full trial.

With no jury present, a judge will hear arguments from Zimmerman's lawyers and from prosecutors representing the State of Florida.

If the judge finds that Zimmerman was in fear of "great bodily harm," under Florida's "stand your ground" law, the judge must throw out the charges against him.

If that happens, not only would he not go to prison for the shooting, Zimmerman also can't be sued for "wrongful death" by Trayvon Martin's family under the law.
