Sanford, FL -- The state has filed a motion in the George Zimmerman murder case saying an inquiry is necessary to make sure the defense is treating witnesses with respect.

The motion comes after an Instagram picture of defense attorney Don West eating an ice cream cone with his daughters surfaced online with the caption "We beat stupidity celebration cones" and "#dadkilledit."

The picture was posted last week after West cross-examined Rachel Jeantel, the last person to talk with Trayvon Martin before the teen was killed.

At times the questioning between West and Jeantel seemed tense during her testimony.

In the 2-page motion filed on Tuesday, the state says an inquiry is needed to make sure all parties to this incident ensure that witnesses and court proceedings are treated with respect and not as occasions for inappropriate jokes.

West has said he didn't post the picture or the captions underneath the image, saying one of his daughters did it.

According to the Associated Press, West said in a court filing on Tuesday that the photo was also taken a day before Jeantel testified. He called the prosecution's motion "irresponsible."

Zimmerman is charged with second degree murder in the shooting death of Martin. If convicted, Zimmerman could be sentenced to life in prison.
